Patron Points Terms Of Use

Persons who want to participate (each a "participant") in the Patron Points program must obtain a Patron Points card at a participating location. These terms and conditions apply to the use of a Patron Points card at any participating location.

A participant may begin accruing points with a Patron Points card immediately upon receiving the card and making a qualifying purchase using an approved payment method. To redeem points and receive other member benefits, the participant must register their Patron Points card at a participating location or at https://patronpoints.com.

Eligibility to be a registered participant will be determined at the sole discretion of Patron Points, Inc. Participants must be at least 13 years of age. Participants must be a legal resident of the United States.

Participation is void where prohibited. Patron Points, Inc. reserves the right to validate the information provided in a participant's registration. All information provided must be correct and accurate.

By obtaining and using the Patron Points card, the participant agrees to be bound by the current Patron Points terms and conditions, which can be found at participating locations and at https://patronpoints.com. Patron Points, Inc. may amend the Patron Points terms and conditions or any specific Patron Points promotion at any time in its sole discretion. It is the participant's obligation to keep informed of the latest Patron Points terms and conditions. Participants understand and agree that Patron Points may collect and use information relating to a participant's purchases, preferences, and program participation. Participants must present a valid Patron Points card or valid participant identification at time of purchase to earn points. Points will not be earned without a valid card or valid participant identification or for previous purchases. Patron Points cards are not transferable. Points will not be earned or accumulated for tobacco products, alcoholic beverages, lottery, phone cards, money orders, gift card purchases, licenses and other items prohibited by law. Patron Points, Inc. reserves the right to amend this list and ineligible items can be found at participating locations or at https://patronpoints.com.

Patron Points may be redeemed by a registered participant for all qualifying products at participating locations. Patron Points, Inc. may offer a smartphone/electronic device application (the "Service"). If the Service is offered, your use of the Service would constitute (a) your express consent to receive communications to your mobile telephone or device, and (b) your acceptance to be bound by these Terms & Conditions. If you do not agree to these Terms & Conditions, you must immediately discontinue your use of the Service by following the instructions that will be specified at a participating location or at https://patronpoints.com and by deleting the app from your phone or other devise. You can register for the Service by following the registration instructions that are specified at a participating location or at https://patronpoints.com. By registering for the Service, you would receive alerts from us related to promotions, products, special offers and other related news of us that we think will be of interest to you. Message and Data Rates may apply to the Service. If you elect to use the Service, you agree to pay your wireless carrier any fees that correspond to the Service. To provide the Service, we will collect and retain your mobile telephone or device number. We may use this information to distribute information based on your area code, address and purchase history. You will have the ability to opt-out of the Service at any time by following the "opt out" instructions specified above. We reserve the right, without notice and in our sole discretion, to terminate your use of the Service at any time and for any or no reason. Patron Points, Inc. may substitute any rewards or prizes for those of a comparable or greater value without notice.

Patron Points, Inc. is not responsible for any errors or lost rewards resulting from computer hardware or software errors, fraud, third party error, or participant's negligence or unauthorized use.

All Patron Points cards are licensed by Patron Points, Inc. The participant has no ownership interest in the Patron Points card. Participants have no right, title, or interest to copyrights, trademarks and other intellectual property used by Patron Points, Inc. or its parents, subsidiaries or affiliates in conjunction with the Patron Points program. Patron Points, Inc. may cancel any Patron Points card at any time at its sole discretion. Patron Points, Inc. may require any participant to surrender or return the Patron Points card at any time.

PATRON POINTS, INC. MAKES NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTY OF MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE, REGARDING THE CARD, THE USE THEREOF, OR ANY GOODS OR SERVICES OBTAINED THROUGH ITS USE OR PARTICIPATION IN THE PROGRAM.

Participants agree by participating in the Patron Points program that Patron Points, Inc., its parent, subsidiaries, and affiliated companies, units and divisions and advertising and promotional agencies, and each of their respective officers, directors, employees, representatives and agents ("Released Parties") will have no liability whatsoever for, and shall be held harmless by participants against any and all threatened or actual actions, claims, liabilities damages, (including third party claims) personal or bodily injuries (including death or disability), costs and expenses (including reasonable attorney fees), losses or property damage ("Claims") arising in any manner, directly or indirectly, from or relating to the Patron Points program, including but not limited to acceptance, possession, loss, use or misuse of any Patron Points coupon or benefit. By participating in the Patron Points program, each participant agrees to fully indemnify the Released Parties from any and all such threatened or actual Claims by third parties without limitation.

Patron Points, Inc. reserves the right to terminate the Patron Points program at any or all participating locations, at any time without prior notice. The Patron Points program shall be governed by the laws of the state of Minnesota, without regard to its or any other jurisdiction's laws governing conflicts of laws. Any claims or actions regarding or arising out of the Patron Points program shall be brought exclusively in a court of competent jurisdiction located in St. Paul, Minnesota, and participants expressly consent to and waive any objections to the personal jurisdiction of such courts.

These Terms and Conditions constitute the entire agreement with respect to participating in the Patron Points program. If any provision of these Terms and Conditions is unlawful, void or unenforceable, then that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.
